Welcome to GeoTrend. These Terms of Service (“Terms”) govern your access to and use of our Artificial Intelligence (AI) and Generative Engine Optimization (GEO) website analysis services, including our web platform and integrated tools (collectively, the “Services”), provided by Haysoft IT (“GeoTrend”, “we”, “us”, or “our”), located at Maximilianstr. 14, 41472 Neuss, Germany. By accessing or using the Services, you agree to be bound by these Terms.

1. Use of the Services

a. Eligibility: You must be at least 18 years old to use our Services.

b. Account Registration: To access certain features of our Services, you may be required to create an account. You agree to provide accurate and complete information during registration. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

c. Prohibited Activities: You agree not to use the Services for any illegal purpose, interfere with the system integrity, engage in reverse engineering, use our data to build a competitive product, or use automated bots or scripts to bypass our usage limits.

2. Fees, Payments, and Renewal

a. Subscription Fees: Access to premium features of the Services requires a paid subscription. All payments are securely processed via Stripe and are stated exclusive of applicable taxes. Payment is due in advance for the selected billing period.

b. Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can cancel your subscription at any time through your account settings.

3. Refund Policy

a. Limited Refund Policy: Refund requests are only evaluated within the first 7 days of purchase and solely in cases where our service has demonstrated a technical failure or inability to perform as advertised.

b. Ineligibility for Refunds: If you have successfully utilized premium features (e.g., accessed advanced analysis results, downloaded PDF/JSON reports, viewed AI visibility metrics, etc.), no refund will be issued. By using these features, you acknowledge and agree that the service has been successfully delivered.

c. No Refunds for Renewals: Subscription renewals are not eligible for refunds under any circumstances. If you do not wish to continue the service, you must cancel your subscription before the renewal date.

4. Service Disruptions and Technical Limitations

a. Website Access Limitations: We cannot guarantee that all websites can be successfully analyzed. Certain websites may be inaccessible to our analysis tools due to technical restrictions, including but not limited to:

• Bot-blocking mechanisms and anti-scraping measures
• Firewalls and Content Delivery Network (CDN) protections (e.g., Cloudflare, Akamai)
• Geographic restrictions or IP blocking
• Robots.txt restrictions
• Password-protected, gated, or members-only content
• Server timeouts and unavailability

If our Services cannot fully access or analyze a website due to these technical limitations, no refund or credit will be provided. It is your responsibility to ensure your website is accessible to our analysis tools.

b. Third-Party Dependencies (AI Models): Our Services rely on third-party AI APIs (such as OpenAI, Anthropic, Google) and search engine results. Updates, outages, or modifications within these third-party systems may affect our analysis results. We are not responsible for the availability or performance of these external systems.

5. User Responsibility for Implementation

IMPORTANT: GeoTrend provides analysis, recommendations, and optimization suggestions only. All technical implementations are your sole responsibility.

a. Advisory Service Only: We do not implement changes to your website, modify your code, or execute any technical tasks on your behalf.

b. Limitation of Liability for Implementation: GeoTrend shall not be held liable for any website downtime, data loss, code conflicts, technical bugs, or negative impacts on search engine rankings resulting from your implementation of our recommendations or generated data (such as JSON-LD, LLMs.txt, etc.). It is highly recommended to test all changes in a staging environment and back up your website before deploying to production.

6. Disclaimer of Warranties (Limitation of Liability)

THE SERVICES ARE PROVIDED “AS IS”. GEOTREND MAKES NO GUARANTEES, WARRANTIES, OR PROMISES REGARDING THE OUTCOME, EFFECTIVENESS, OR SUCCESS OF IMPLEMENTING ANY RECOMMENDATIONS. Specifically, we do not guarantee:

• Improved search engine rankings or visibility
• Citations, mentions, or references by AI systems, chatbots, or large language models
• Increased website traffic, conversions, or revenue

GEO and SEO outcomes depend on numerous complex, constantly changing factors entirely outside our control, including search engine algorithm updates, competitor behavior, and AI model changes.

Limitation of Liability: To the fullest extent permitted by applicable law, the total aggregate liability of Haysoft IT shall not exceed the amount you paid to GeoTrend in the twelve (12) months preceding the event giving rise to the liability.

7. Intellectual Property

All software, infrastructure, and design rights related to the Services belong exclusively to Haysoft IT. You retain ownership of any content you submit for analysis; however, you grant us a worldwide, royalty-free license to use and process this content solely for the purpose of delivering the Services.

8. Termination

We reserve the right to suspend or terminate your account and access to the Services at any time, without prior notice, for violations of these Terms, suspected fraudulent activity, or abuse of the Services.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Neuss, Germany.
